This is the most common reason for denial, and it is rarely about the severity of your condition. It is almost always about documentation. The SSA needs records that establish not just your diagnosis, but how your condition limits your functional capacity, meaning what you can and cannot do physically and mentally. If your treating physician's records consist mainly of brief office notes rather than detailed assessments, the SSA will fill in the gaps with their own Consultative Examination (CE), often conducted by a physician who has never met you.

In 2026, the SGA limit is $1,690 per month for non-blind claimants and $2,830 per month for blind claimants. This sounds straightforward, but the rules have important nuances: the Trial Work Period allows SSDI recipients to test their ability to return to work, and certain work-related expenses can be deducted from countable income. Your Condition Is Not Expected to Last 12 Months

The SSA requires that your disabling condition either has already lasted 12 months, is expected to last at least 12 months, or is expected to result in death. Failure to Follow Prescribed Treatment

If you stopped medical treatment or did not follow your doctor's recommendations without a documented reason, the SSA may deny on this basis. Accepted exceptions include inability to afford treatment, religious objections, treatment side effects that are themselves disabling, and medical contraindications. Lack of Work Credits (SSDI Only)

SSDI is funded through the Social Security taxes you paid while working. If you do not have enough work credits, you do not qualify for SSDI, regardless of the severity of your condition. Most workers need 40 credits total, with 20 earned in the last 10 years before becoming disabled, though younger workers have lower thresholds. The first 24 to 48 hours after a denial are not the time to decide whether to appeal. They are the time to protect your options. Here is the order of operations:

1. Note your deadline. You have 60 days from the date printed on your denial letter to file your appeal, plus 5 days the SSA assumes for mailing. Missing this window means starting over: a new application, a new filing date, and the loss of any back pay that had been accumulating.
2. Do not file a new application. This is the most common and most costly mistake. Refiling restarts the clock, abandons your original filing date, and typically results in another denial on the same record. Appeal the existing decision.
3. Secure all SSA correspondence. Gather your denial letter, your original application confirmation, and any prior communications from the SSA. This is the foundation of your appeal file.
4. Do not stop medical treatment. Gaps in your treatment record during the appeal period signal to the SSA that your condition may be improving. Continue following your prescribed treatment, and document everything.

Common Mistakes After a Disability Denial: What to Avoid

The period after a denial is when many claimants unintentionally damage their cases. These mistakes are preventable.

1. Filing a brand-new application instead of appealing. When you refile, you lose your original application date. Every month your claim was pending represents potential back pay. Abandoning that date means abandoning those benefits. The only situation where refiling may make sense is if your condition has significantly worsened or you have new qualifying diagnoses. Even then, an attorney should make that call.
2. Missing the 60-day appeal deadline. The SSA enforces this deadline strictly. If you miss it, you can request a late appeal, but you must show "good cause": illness, hospitalization, a death in the family, or similar circumstances. 4. Posting on social media. SSA investigators and vocational experts sometimes review claimants' social media. Photos showing physical activities, travel, or work-related content can be used to challenge your stated limitations. This is not hypothetical. It comes up in hearings.
5. Assuming you cannot afford an attorney. SSD attorneys work on contingency. If you win, the SSA pays your attorney directly from your back pay, capped at 25% of back pay, with a maximum dollar amount of $9,200 set annually by SSA. If you do not win, you owe nothing. The 4 Levels of the Disability Appeals Process in California

California follows the same four-level federal appeals structure as every other state. Each level requires action within 60 days of the prior decision. Here is what each stage involves, what to expect in California specifically, and how representation affects your odds.

Level 1: Reconsideration

Reconsideration is a review of your claim by a different SSA examiner at California's Disability Determination Services. This is someone who was not involved in the original decision. You can and should submit new medical evidence at this stage. California is a full reconsideration state, meaning you must complete this step before requesting an ALJ hearing.

The approval rate at reconsideration is low, roughly 10 to 15% nationally. Most claimants are denied again and proceed to the ALJ hearing. That does not mean reconsideration is pointless. The ALJ hearing is where the majority of winning cases are decided. You appear before an Administrative Law Judge, in person at a California SSA hearing office or by video and present your case directly. Level 3: Appeals Council Review

If the ALJ denies your claim, you may request review by the SSA's Appeals Council within 60 days. The Appeals Council in Falls Church, Virginia reviews the hearing record for legal errors. It does not conduct a new hearing. The Council can grant benefits, deny review, or remand the case back to an ALJ for a new hearing. The timeline is typically 6 to 12 months. The Appeals Council denies review in the majority of cases, but a remand is a meaningful second chance at the hearing level.

Level 4: Federal District Court

If the Appeals Council denies review or upholds the ALJ denial, the final option is filing a civil action in U.S. District Court. Federal court review is limited to the administrative record. No new evidence is introduced. The court looks for legal errors in the SSA's decision, not whether the outcome was correct on the facts. This level is pursued in a minority of cases, typically when there are clear legal errors in the ALJ's analysis of medical evidence or vocational testimony. 1. Get a detailed RFC opinion from your treating physician. 4. Gather third-party statements. Written statements from family members, friends, or former employers who have observed your limitations in daily life or at work provide corroborating evidence that medical records alone cannot capture.

For SSDI, back pay is calculated from your established onset date (the date SSA determines you became disabled), back to a maximum of 12 months before your application date.
