What Happens After a Social Security Disability Denial

A denial is not the end of your claim. About two-thirds of initial Social Security disability applications are denied nationally, and the appeals process exists because Congress built four layers of review into the system. The examiner who denied your file is not the final word.

The first thing to know is the deadline. From the date you receive your denial notice, you have 60 days to file the next appeal, plus five days SSA presumes for mail delivery. Miss the deadline without good cause, and you lose the appeal, forcing you to start over with a new application and a new onset date. That single procedural error costs claimants years of back pay every year.

SSDI vs SSI Appeals: Are They Different?

The four-stage appeal process is identical for SSDI and SSI claims. The underlying eligibility rules and back-pay calculations are what differ. If your denial covered both programs (many claimants file concurrent claims), one appeal moves both forward.

Stage 1: Request for Reconsideration

Reconsideration is the first appeal stage, where a different SSA claims examiner reviews your file. You have 60 days from your denial notice to file, using Form SSA-561 (Request for Reconsideration) and SSA-3441 (Disability Report Appeal). California requires this step.

What you submit here matters. The reconsideration examiner works from the same file the initial examiner had, so a fresh look without new evidence rarely changes the outcome. What moves the needle:

• Updated medical records from every treating provider since the initial application
• Recent diagnostic testing (MRIs, EMGs, pulmonary function tests, psychological evaluations)
• A functional capacity statement from a treating physician addressing specific work-related limitations
• Documentation of any hospitalizations, ER visits, or new diagnoses
• Third-party statements from family, former employers, or caregivers describing daily limitations

National reconsideration approval rates are low. That is not a reason to skip the stage. Reconsideration is procedurally required in California, and the record you build here follows the file to the hearing stage.

Stage 2: Hearing Before an Administrative Law Judge (ALJ)

The ALJ hearing is the appeal stage where most claimants who eventually win benefits do so. You have 60 days from the reconsideration denial to request a hearing, using Form HA-501. The Administrative Law Judge holds an in-person, video, or phone hearing where you testify along with, in most cases, a vocational expert (VE), and sometimes a medical expert (ME).

Wait times at this stage are long. The national average sits around 267 days from request to hearing date. Every OHO runs differently, and we prepare for local scheduling patterns and judge tendencies accordingly.

Here is what happens at the hearing:

1. The ALJ opens the record and confirms the exhibits (your medical file, work history, prior determinations).
2. Your attorney gives a brief opening statement identifying the medical listings at issue and the theory of disability.
3. You testify about your medical conditions, symptoms, daily activities, and past work.
4. The vocational expert testifies about your past jobs and answers hypothetical questions from the ALJ about what work someone with your limitations would still be able to perform.
5. Your attorney cross-examines the vocational expert. This is where many hearings are won or lost.
6. A medical expert, when present, testifies about whether your impairments meet or equal a listing.
7. Closing arguments, either at the hearing or in a post-hearing brief.

Cross-examination of the vocational expert is the single most technical part of any disability hearing. Stage 3: Appeals Council Review

If the ALJ denies your claim, you have 60 days to request review by the Appeals Council in Falls Church, Virginia, using Form HA-520. The Appeals Council does not hold a new hearing. It reviews the ALJ's decision for legal or procedural error and issues one of three outcomes:

1. Denial of review. The Council declines to hear the case. The ALJ decision stands, and your next step is federal court.
2. Reversal. The Council reverses the ALJ and approves the claim outright. This is uncommon.
3. Remand. The Council sends the case back to the ALJ (usually the same judge, sometimes a different one) with instructions to correct a specific error. This is the most common favorable outcome.

The written argument at this stage is different from the hearing brief. The Council reviews the record as it stood at the hearing, so the argument is about what the ALJ did wrong: misapplied a listing, ignored treating-source evidence, failed to consider a limitation, or built the RFC on improper vocational testimony. Wait times here are substantial. Sackett's existing timeline data suggests 24 to 36 months.

Approximate remand and reversal rates at the Appeals Council level are lower than most claimants expect. That is why the strength of the ALJ hearing record matters. A weak record limits what the Council has to work with. A well-preserved record with clean cross-examination and a thorough post-hearing brief gives the Council specific errors to act on.

Stage 4: Federal Court Appeal

If the Appeals Council denies review or upholds the denial, your final option is to file a civil action in U.S. District Court. This is not another SSA review. It is a lawsuit filed in federal court, subject to the Federal Rules of Civil Procedure, with a 60-day filing window from the Appeals Council's notice.

For California clients, the case is filed in the U.S. District Court covering the claimant's residence (the Northern, Eastern, Central, or Southern District of California). Appeals from any of these go to the U.S. Court of Appeals for the Ninth Circuit.

What is arguable in federal court is narrow. The District Court reviews the administrative record for legal error or lack of substantial evidence. You are not re-arguing whether you are disabled. You are arguing the ALJ applied the wrong legal standard, ignored binding regulations, or reached a conclusion no reasonable factfinder would reach on the record. Common winning arguments include improper rejection of treating-source opinion, deficient credibility analysis, and vocational testimony inconsistent with the Dictionary of Occupational Titles.

Deadlines to File Each Appeal Stage

Every SSA appeal deadline is 60 days from the date you receive the denial notice, and SSA presumes you received it five days after the date on the notice unless you show otherwise. That gives you an effective 65-day filing window in most cases.

If you miss the deadline, "good cause" under 20 CFR 404.911 is the only path to a late appeal. Good cause is narrow. SSA has recognized it for serious illness, death in the immediate family, records lost by SSA, misinformation given by SSA, and other limited circumstances. It does not include forgetting, thinking the denial was final, or waiting to hire an attorney.

Common Reasons Disability Appeals Get Denied

Denials at every stage tend to fall into the same handful of patterns. Knowing them ahead of time is how you avoid repeating the mistake:

1. Insufficient medical evidence. The single most common reason. Treating-source records are missing, incomplete, or fail to document the specific functional limitations SSA needs to see.
2. Missing the 60-day deadline. A procedural miss ends the appeal and forces a new application.
3. Failure to attend a consultative examination. If SSA schedules a CE and you do not attend without good cause, the file is decided on incomplete evidence.
4. Substance abuse in the record. When substance use is documented, SSA has to determine whether the disability would exist even without the substance use. Poor documentation of that distinction often results in a denial.
5. Working above the SGA threshold. Substantial Gainful Activity is a hard line. Even part-time work over the monthly SGA limit disqualifies most claimants.
6. Failure to follow prescribed treatment. If treatment would restore work capacity and the claimant declines it without a documented reason (side effects, cost, religious objection), SSA denies. Documentation of the reason matters.
7. Weak vocational testimony left unchallenged. At the hearing stage, unopposed VE testimony that overstates transferable skills is a recurring cause of denials.

How Long Does the Appeal Process Take?

Timelines vary by stage, by state DDS backlog, and by the specific hearing office. National averages give you a baseline, but California has its own patterns, and San Francisco has its own within California.

Two things drive those timelines: the SSA's own backlog, and how completely the file is developed when it hits each stage. A file with gaps triggers additional development requests, which add months. A file that is complete on arrival moves. Here's the thing: the difference between "eight months" and "eighteen months" at the hearing level is often the quality of the file the case walks in with.

Receiving Benefits While Your Appeal Is Pending

In most cases, no. If you have never been approved, you do not receive SSDI or SSI benefits during the appeal. Two exceptions matter:

1. You were already receiving benefits and SSA is proposing to terminate them. You have the right to request continuation of benefits during the appeal, using SSA's continuation election on the appeal form. If you ultimately lose, SSA might seek repayment of continuation payments.
2. SSI presumptive disability. For certain severe conditions (blindness, ALS, terminal illness, certain amputations), SSI presumptive disability payments begin before final approval for up to six months.

For California workers, State Disability Insurance (SDI) is often the bridge. SDI is a separate state program paying up to 52 weeks of short-term disability if you paid in through payroll deductions. SDI and SSDI pay concurrently for the covered period. If you have not yet applied for SDI and your California work history qualifies, do it early.

How Much Does a Disability Appeal Lawyer Cost?

Social Security disability lawyers work on contingency. Fees are federally capped at 25% of your back pay, up to a maximum dollar cap of $9,200 set by the SSA. You pay nothing if you do not win.

Every fee agreement in an SSA administrative case has to be approved by SSA under 20 CFR 404.1720. This approval process is a claimant protection: it caps the total fee and makes the attorney's payment contingent on your success.

The federal court stage has a different fee framework. Section 406(b) of the Social Security Act governs court-stage fees, and the Equal Access to Justice Act (EAJA) allows for recovery of fees from the government when SSA's position was not substantially justified. What you should never pay: an upfront retainer for a Social Security disability case at the administrative level. Any firm asking for that is operating outside how the system is designed to work.
